The Racist Rants of Dr. Leslie Seppini & Nancy Grace

Those who watched Dr. LESLIE SEPPINI on the Nancy Grace show on Monday, May/21 (after the Dharun Ravi sentencing) were filled with dismay as she spewed one lie after another.  The Nancy Grace show is on HLN, a subsidiary of CNN.  Dr. Seppini also spoke extensively during the Casey Anthony trial and even wrote a book about it afterwards.  Judging by her behavior and her commentary on Monday, I am inclined to think that her entire work and her books must be full of lies as well.  Either she is too dumb to do proper research or purposefully lying in order to keep up a media persona of the kind that Nancy Grace expects of guests on her show.  Dr. Seppini claims that Dharun is in this country as a student on a student visa!  In fact, Dharun is a Permanent Resident, aka a Green Card holder.  The only thing that is true is that even Green Card holders can be deported.  There is no protection against deportation unless you are a United States Citizen.  However, when one does become a US Citizen, like Raj RajRathnam, bigots like Nancy Grace and Leslie Seppini will claim that they are a "flight risk" because they have a country to go back to and so should be imprisoned!  You see, with such bigots, you cannot win either way.

Here is the letter that I wrote to her today and hopefully she or her staff will research the Dharun Ravi situation further and come to their own conclusions that everything that she said on the Nancy Grace show on Monday, May/21/2012 was a LIE!

Dr. Seppini,

I watched with considerable dismay about your portrayal of Dharun Ravi when you on the Nancy Grace show on HLN.  Specifically, let me tell you this – Dharun is NOT an illegal immigrant because you came very close to saying that.  Neither was a visiting Foreign Student.  He is  a Permanent Resident of the United States, commonly known as the Green Card.  He came to the USA when he was 5 years old with his parents who came here on “Highly Skilled Immigrant” Visas.  Dharun and his parents were eligible to become American Citizens several years ago but chose NOT TO and that is their right.  Your portrayal of Dharun Ravi as some kind of immigrant leech is way beyond reprehensible.

If you would like my viewpoints on the Dharun Ravi case, please visit http://www.thelaymanspeaks.com.  I think your rabid commentary coupled with Nancy Grace’s bigoted opinions colored by racial hatred towards Indians (she kept saying, “India Born Dharun Ravi,” several times during her show).  You offer up factually incorrect, outright lies about the Dharun Ravi case and that makes me wonder – how much truth do you really have to say about Casey Anthony?  As the child of an African American father, I wish you were more balanced and open minded.  Instead, sadly, I see that through straight faced commentary, you are painting Dharun Ravi and by implication Immigrants just like him, with a broad brush that makes us we are not welcome here. 

One act cannot forever tarnish the character and reputation of an individual and one act cannot reflect on the entire Immigrant student community as you portray it.  Yes, an Immigrant who comes into this country for studies or anything else must strive to lead a law abiding existence just like any American is expected to. However, man is by definition, imperfect and you of all people (with your Psychology degree) would be expected to know that!

How Much to Tip at Supercuts?

A couple of days ago, I went to Supercuts to have a haircut.  As usual, I got a nice haircut from Nicole who has known me for over 7 years now.  I always ask for her every time because she knows how I like to style my hair and she does a great job too.  The haircut costs $15.95.  I always tip $5.

Now, I never gave a second thought about it because I always knew that I was tipping a little above normal.  I knew Nicole and I always tip people I know more generously than others I don't know.  However, as a GOLD STANDARD, my rule of thumb for tipping is this - 20% for good service, 15% for average or substandard service.  I don't punish anyone for bad service beyond this, because I think everyone has good and bad moments and in America, most people in the service industry who survive on tips need them. You wouldn't decide not to pay for your meal if it was lousy, would you?   Of course the restaurant might decide to comp you, but you don't get to decide whether to pay or not. 

Now, this time, at Supercuts, I was in for a surprise.  I saw two customers before me tip ridiculously low amounts - $1 in one instance and $2 in the other instance.  That is a tip from the 1990's!  I  was amazed to see the Supercuts employees smile and just accept the tips and they did not look at the tip with disgust.  One might say that reflects a well trained employee, but I felt sad for them.  A $1 tip for a haircut these days is never acceptable.  In fact, it is ridiculuous.

20% of $15.95 is $3.20, and a $3 tip would be decent.  Anything less had better have a good explanation such as "bad service"! If one cannot afford to tip decently, it is better to not tip at all.

Rite Aid - "With us it is Personal"

Sometimes, companies come up with ridiculous slogans or tag lines such as this one - "With us it is personal."  This is the tag line of Rite aid Pharmacy.  I wonder who comes up with these slogans and what they really expect out of it!  If one does not follow through on slogans such as these, the customer starts to lose respect for such corporations.  After all, if you cannot carry your motto through, consistently and efficiently all the time, then why even have it?  Read the letter below that I wrote to the customer service department of Rite aid, it is self explanatory.

As a former Walgreen's Customer for the past 12 years and a transfer due to the Express Scripts fiasco, I am a little disappointed by your practice of your motto - "With us it is personal".  That motto rings loud and shallow and I will explain why.

Last night on Friday, May/25, I stopped by this Pharmacy in Brookfield, CT and there were only two people working at the Pharmacy - the Pharmacist and the Technician.  I find two problems with the transaction that would have been handled very differently by George or his associates at Walgreen's.

(1) I had a prescription for which there was available a manufacturers rebate for COPAY reimbursement up to $100.  However, there was a problem since the doctor had written a 90 day prescription and the voucher would only cover $100 so the resulting COPAY was higher than the actual supposed $10.  The pharmacist told me that "it is what it is."  Thinking quickly and remembering what George at Walgreen's would have done, I asked the pharmacist to try putting in for only one month supply and VIOLA, it worked - you see, it is up to $100 per FILL, so it is in the customer's best interest to FILL EVERY MONTH rather than every 90 days where the COPAY is higher.  George used to tell me that it was not the customer's job to think for himself - it was Walgreen's responsibility - a duty fostered by deep caring for the customer.  I wish the pharmacist had done some thinking about it for herself and said to herself - "This is my customer.  How can I help him out?"  Instead this "it is what it is" stuff is way wrong!

(2) There was another prescription that needed to be filled and the pharmacist asked me to come back 20 minutes later to pick it up.  I did.  When I came back, she asked for my date of birth, address and other identifying information.  All of this just 20 MINUTES LATER.  Remember, I had just had a lengthy conversation with her in an EMPTY STORE!!!!  I mean, come on, I will give her some slack and I will explain why, but asking to fully identify oneself some 20 minutes later?  The slack that I will give her is that she wanted to verify that I was being given the right medication and protect herself from a mistake by not giving me somebody else's medication.  That is all good.  But I saw her looking at the medication packet and I wanted to support her with my premise but was dismayed when I saw that none of what I told her could be cross referenced and verified by just looking at the cover she was handing over to me.  There was my name and nothing else - ZIP, NADA!  So, instead of my premise that she was trying to make sure she was not making a mistake when dispensing the medication to me - all she was doing was verifying my name!  That is all.  The purpose of asking all those questions was to verify my identity, something that appears ridiculous after only 20 minutes.

George at Walgreen's would never do that and none of his staff would.  They would ask for my address and that is all - a good question every time because that is on the prescription cover and they are making sure that the right patient gets the right medication.  They knew me well enough to know that asking me to fully identify myself every time would have been a joke.

I have to be reasonable and admit that the Pharmacist was OK, not rude or impersonal and at least decent - I will give her that much although I wish she smiled.  If it is "Personal with you" as your motto claims, you must smile and I must be made to feel that I must come back every time (although every patient hopes not to have to ever go back to either a doctor or a pharmacy).  The pharmacy technician did recognize me when I dropped off the prescription and smiled at me and even said - "I know I have filled a prescription for you before."  So, I know that there is hope for you!

This RITE AID was a DESERTED, LOSS MAKING store before Express Scripts came along and messed everything up for Walgreen's and its customers.  Ranked against Walgreen's on a scale of 1 to 10 with 1 being the lowest, last night's experience gives you a ZERO "0"

I wish I could go back to Walgreen's.  GOD help me!

Christian Pastors Loading up on the LGBT Community

Now, this is utterly shameful!  While the entire media is castigating the Honorable Judge Glenn Berman for giving Dharun Ravi what they perceive is a very light sentence, there are Christian Pastors around the country going around making sermons of the extreme volatile kind, suggesting concentration camps for Gays and Lesbians among other nasty prescriptions that include killing and mass genocide.  The media gave lip service to those sermons and only said that the people around these pastors were "embarrassed."  As if that is all that needs to be said about such craven, distasteful behavior!

I have said before and I will say it again now.  Hinduism is all inclusive, and Gays and Lesbians and others with an alternative lifestyle have as much a place in Hinduism as anyone else.  GOD accepts all of us for who we are or who we choose to be.  There is nothing wrong or shameful in that.  On the other hand, it appears that Christianity at a minimum through Bible preachings and Pastoral Sermons showers hatred upon the LGBT community and ostracizes them!  So, is it really hard to surmise that the media sponsored hatred for Dharun Ravi is all about his being an Indian and not anything to do with his perceived Gay hatred?  NO!  This is racial hatred for Indians - albeit disguised as social righteousness, but hatred nonetheless towards a minority community that is incredibly prosperous and living the ultimate Immigrant American Dream.  I am saddened by all this.

The following posts show the extent to which the media and the general American public condone hatred towards Gays and the LGBT community.  I encourage my readers to reach their own conclusions about the impact of such crass behavior by religious leaders who are supposed to spread the word of the Lord!  Is this what Christianity really teaches?  Is that the word of GOD and the LORD - that Gays and Lesbians should be killed and exterminated?  Is that the background under which the most Christians in this country have been judging Dharun Ravi?  Come on!  Dharun is HINDU and our religion celebrates the existence of Gay and Lesbian individuals among others!  I am extremely proud of the broad minded, GOD given religion that I belong to - I am proud that my religion does not promote hatred like the Bible!

Now, I know of no Hindu leader or Guru or Saint that promotes killing Gays and Lesbians like these Christian Pastors.  There is no hatred in the soul of any Hindu for a Gay or Lesbian individual.  Why?  Because none of our scriptures tell us to hate or kill Gays and Lesbians unlike the Bible!

The Story of Mohini - An Avatar of Lord Vishnu

My previous post about Hinduism and its tolerance for GAYS and members of the LGBT community as exemplified by Hindu Mythology is bound to raise consternation among many circles and my analysis and interpretation is bound to be challenged.  So, in order to provide greater perspective to this story, I am posting here a Wikipedia link so that people can start here for research.  I encourage everyone to research this thoroughly and reach the same reasonable conclusion that I reached myself - that the object of the story is to teach tolerance because even GODS embrace homosexuality and there is nothing wrong with it.



Open Letter to Middlesex County Prosecutor - Bruce Kaplan

Dear Mr. Kaplan,

My name is Ramesh and I am a United States Citizen residing in Connecticut.  I briefly lived and worked in New Jersey in 1998 and 1999 and then moved on to Connecticut.  I am writing this open letter to you with the hope that this letter somehow reaches you in time for you to take timely action. 

I am appealing to your sense of magnanimity, compassion and understanding in order that you may find within your prosecutorial powers and discretion to let Judge Glenn Berman’s sentencing decision stand and allow Dharun Ravi to move on with his life that will anyway be restricted for the following three years under probation.  I am requesting your office to NOT appeal the Judge’s sentence imposed yesterday.  Your office along with the Jury and the Judge has sent a clear enough message – Bullying is wrong, it will not be tolerated and will be punished regardless of whether the victim gets satisfaction from seeing his tormentor punished.   However, the overwhelming public opinion also is that your office is also seeking to send the message that hating Gays and members of the LGBT community is wrong and that any behavior that even remotely borders on such hatred will also be severely punished.  While I sincerely applaud your desire to send such a message in an effective manner, I would like to explain why Dharun Ravi is the wrong example for this.  This case is not the right one to send the message that you want to send.

Like Dharun and his parents I come from the Southern State of Tamil Nadu in India, where I was born.  Fellow Indians call us “Tamilians”.  I chose to become an United States Citizen after living in this country for over two decades, a choice that neither Dharun Ravi or his parents made although they had the opportunity, the means and the incentive.  It is indeed an honor and a privilege to become a Citizen of the greatest country on earth, but many legal immigrants, including Dharun and his parents consciously make the choice of not becoming one because of reasons peculiar to people of Indian origin.  India is the world’s largest democracy, although in the eyes of many it is still an economically poor one.  The reasons to leave India could be many, including economic conditions, but there is never a reason not to return and settle down there after one has spent a useful and productive life here in the USA.  None of us chose to run away from anything including religious or political persecution and most of us in fact did not come here because we lacked economic prosperity or even decent living standards.  Therefore, Indians do not have the pressing need to become American Citizens, although they are well positioned in front of  the line thanks to America’s selective immigration policies that targets India’s highly educated workforce.  Dharun did not come here to the USA to study on a student visa as alluded to by many commentators.  Indeed, he came legally into this country along with his parents who chose to come here for work on a legal work visa as highly talented and qualified IT workers.  They came to the USA in the 1990’s, giving them ample time to become American Citizens.  However, for reasons best known to them, they chose not to.  The key point to remember is that Dharun is a Permanent Resident of the United States, not some graduate student who came to America a couple of years ago.  If Dharun and his family had made the choice of becoming American Citizens, there would never be any loose talk of "Deporting" him.  Dharun had the right, the means and the opportunity to become an American Citizen and he did not.  So, it is ironic that there is so much talk about how much of a factor deportation was in all of this.  Of course, you already know all of this.

The United States Government by either design or conscious choice provides only one viable straight path for Indian Citizens to immigrate into this great country – bring exceptional skills and education and enhance everything by even more advanced education.  Needless to say, Indians who have arrived and settled in the USA are among the brightest, prosperous and law abiding citizens of this land, with a crime rate that I can guarantee is the lowest in the USA.  We are often called “Model Immigrants”, but truth be told, there is nothing “Model” about us.  Indians are by nature harmless, non-threatening, non-violent, extremely law abiding and GOD fearing people who through tens of centuries of the practice of the Hindu religion know nothing better than to strive to be ideal human beings.  In fact, this Hindu influence has even affected people practicing other religions in India, such as Muslims, Christians, Sikhs, Parsis, Jains and Buddhists among others.  India got its independence from the British through a massively non-violent movement where millions of Indians were suppressed, beaten and slaughtered before the British finally gave up and left the land.  Today, millions of Indians continue to thrive and prosper in the United Kingdom as useful, law abiding and prosperous citizens who are full citizens of the British Crown without an ounce of hatred in their hearts to a country that occupied India for over 200 years.

Dharun Ravi and his parents practice Hinduism just like me.  Hindus have evolved over the tens of centuries so much so that some fundamental basic tenets fostered upon us by our great teachers, philosophers, Gurus and Saints have either been lost or lost in translation during the enormous waves of invasion that occurred over the centuries by people from other lands who wanted to steal from India.  In fact, in those days, India was the most prosperous land on earth, so much so that Christopher Columbus lost his way trying to find it, which is why we are here now! Christopher Columbus did not intend to steal from India, he really wanted to trade, but the point I am trying to make is that everyone wanted to go to India, much like everyone is trying to come to the USA these days in the current era.  Today, the United States is the most prosperous, generous, opportunity giving and decent place on this planet, worthy of being home to only the world’s most law abiding individuals.  It is natural to expect that any immigrant to this country come with the intent to lead a full and productive life here that is completely free of even the minutest infarctions, but that is wishful thinking.  Indians are also human beings like any other immigrant and the only thing we can do is to place ourselves, our families and our children in situations that cannot even provide a crucible for any mishap.  That is the best we can do and as you can see from the lowest crime rate in the country, we do it quite well!  Situations like the one Dharun placed himself him can be truly chalked up to immaturity, stupidity and idiocy, but never to malice, hatred or meanness.  Why?  Because it is in our DNA to be good citizens and it is Hindu belief over tens of thousands of years to be tolerant to everyone – all religions, all people and all living beings, including animals. 

The Hindu religion unlike some other major religions does not believe that marriage and union can only be between a man and a woman.  Bravely and openly, Hindu mythologies and stories about our GODS and GODDESSES contain examples of infatuation between male GODS to the extent that it is celebrated even today as plays – the most famous of which is called “MOHINI ATTAM”.  Even after being told that Lord VISHNU was taking an Avatar as MOHINI and was in fact male, Lord Shiva continues to intensely court Lord VISHNU even as his own wife, PARVATI looked on with anxiety and pain!  As in any mythologies, the point of such stories is not just to entertain but to bring a point across and in this case, as Hindu mythologies are won’t to do, influence social behavior. Stories of cows such as KAMADHENU influenced the Hindu culture to such an extent that we don’t eat Beef anymore and stories of Incarnation resulted in a majority of Indians being Vegetarians over the centuries.  Going back tens of thousands of years, Hindus also ate Beef and slaughtered other animals for food. 

I realize that many Hindus after reading this open letter might either disagree with me or admonish me for writing so candidly about our great religion.  Some may perhaps even vehemently disagree with my analysis of the MOHINI story and tell me that I am wrong.  However, as I said, Hindus have evolved over the centuries.  Hinduism is not an organized, strait-jacketed religion like many others.  Every Hindu practices Hinduism in his or her own unique way and not every parent tries to foster their religious ideas onto their children. Dharun Ravi’s parents may or may not have taught Dharun about Hinduism’s great tolerance and acceptance of GAY culture, but please do not for a moment think that they ever brought him up as a GAY hating, GAY bashing individual.  I don’t know Dharun Ravi or his parents, but I can guarantee you that they had no hatred in their hearts for GAYS because I was raised in the same South Indian, Tamilian culture that they share with me.  There just could not have been an ounce of hatred in either Dharun’s heart or his parent’s hearts or in fact in any Hindu’s heart regardless of whether they know or agree with my analysis presentation of Hindu religion.  Dharun Ravi, therefore, is the wrong example to make – for anyone!  The prosecutor’s office will gain nothing from this because there is nothing to deter others from within the Indian community from hating GAYS or members of the LGBT community!  The GAY and LGBT community will have nothing to gain because, through the influence of centuries of practice of the Hindu religion, Indians are already accepting of alternative life styles at one level or at least indifferent at a completely different level.  We don’t have leaders – either religious of political that go about telling us that the LGBT community is an unnatural community of people.  Punishing Dharun Ravi for 30 days in Jail is enough – I am sure he has learnt the costly lesson from his youthful immaturity, but how can he be punished for something that never existed – hatred in his heart?

I also want to bring to your attention the perception that the great State of New Jersey will never be a complete home to the Indian-American community, a key reason why I chose to get up and leave back in 1998.  I never quite figured it out, but it appeared that our prosperity and well-being and our presence as incredibly productive members of the New Jersey community had led to intense jealously and subsequent hatred for us! You are well aware of the hate crimes committed against us through the “DOT BUSTERS’ movement with the perception that the law enforcement community stood by and did nothing to stop the sometimes violent actions of many groups and individuals against Hindu women.  The most recent case of Professor Divyendu Sinha from Old Bridge showcases the perception that it is Okay to kill Indians and law enforcement will not move a finger or at least make just a weak attempt!  I had a choice but chose the more prudent one – of moving away to Connecticut.  But, I know that the Indians who still choose to stay in New Jersey are wondering, “Did we make the right choice?”  I have said before and I will say it again – Indians are one of the most productive citizens of your great State and please do not forget that.  From media utterances by many pundits – political or media, I have gathered the impression that this case because a license to publicly humiliate Indians with the so called perceived notion that somehow Indians are leeches on the New Jersey populace!  DEPORTATION is a word that I have watched with dismay being thrown around pretty loosely! The extreme hatred for Indians is uncomfortably palpable!

I resent the idea that there is the perception out there that Dharun Ravi should be deported forcibly to send a message!  Any Indian immigrant into this country would willingly self deport himself or herself at the blink of an eye and I make this point because we are a people with immense pride!  We are not beggars, and we are not economically desperate runaways who came into this country to run away from something.  We always have a home to go back to a place to call our “Motherland”.  America is our “Homeland”, but India is our “Motherland” because first time immigrants like me were born there.  The idea of harping on the deportation angle appears to send a different message – “We hate these colored Indians anyway, so let us use this excuse to throw these unwanted fellows out!”  It is an extremely powerful impression that has been etched into the minds and hearts of every Indian – that we are somehow not welcome here just because we are quite prosperous, more particularly in the great State of New Jersey!  Is it because we pursued and followed the American Dream and are shining examples of this successfully philosophical dream?  I surely hope NOT!  We embrace this uniquely American idea that Miracles are Possible and if one can put his or her mind to it, one can achieve anything in America!  How can it be wrong to pursue the American Dream?  Does one foolish act by a young 18 year old teen just negate everything?  How mature is a human being at that age?  If both Tyler and Dharun had just been a year younger, we would have been talking a completely different set of circumstances here.

We understand Tyler Clementi’s pain and his family’s pain. Hindus believe that a person’s soul lives on and if Tyler is watching over us or maybe even already amongst us as an already incarnated child, we want his soul to move on in peace.  We say to Tyler – “Dharun did not hate you, although he did something incredibly stupid.”  We also say to the LGBT community out there – please do not judge Indians with the same standards that you judge everyone else.  We are very tolerant and do not have hatred in our hearts!  We embrace all cultures, all religions and all lifestyles and we respect each and every individual, no matter how different.

Mr. Kaplan - Please do the right thing….Please DO NOT APPEAL Judge Berman’s sentence and please show that you are not vindictive towards a member of a law abiding, virtually crime free immigrant community that has done so much for New Jersey!

The Many Dharun Ravi's of America

A reader commented on my first post on Dharun Ravi encouraging Dharun and his parents to try to do a DEAL now, after the fact!  The reader said that I did not understand America's legal system.  Well, that is far from the truth.  Indeed, I understand it extremely well, having been in this country for over 22 years now.

So, why would I suggest something that does not make sense from the normal, sensible point of view?  That is because the unique situation that Indian-Americans find ourselves in this country that for many of us is also our adopted homeland.  Unlike most other immigrants to this country, Indians are a slightly different lot...in fact from my observations over the last two decades, way different and treated way different too.  Why is that?  I will try to answer that partly in this post through a story and slowly over several more posts.

I came to this country in 1990 as a Graduate Student into a midsize Midwest university that formed the basis of a university town in the Midwest.  In those days, we really did not know what to expect, other than we were coming to the most advanced nation in the world.  There was very little Television in India then, so our exposure was limited.  The Internet was virtually non-existent and even though there were networks, information dissemination was not of the exploding variety that there is now.  People talked about Soviet propaganda in those days, but in my opinion, the American press did a more fabulous job of propaganda than any other independent entity on this planet.  To most immigrants from India in those days, the United States of America was an ideal place to start a new life.  How little we knew then!

America today does not resemble the America of 1990 and not just because Barack Obama is President.  There has been considerable evolution since then, but somehow the Indian-American community does not seem to have evolved that much in terms of how it is perceived and how it perceives the rest of America.  The most dramatic evolution in the Indian-American community is the enormous prosperity the IT Revolution and Boom has has on it because truth be told, without the IT Boom, things would be remarkably different today for Indian-Americans.  Up until 1996, I can still remember Indians struggling to find even Engineering jobs that required well qualified graduates of which there were plenty in this community that has a continuous stream of graduate students. Today, there are not even enough H1B visas for IT workers! Most of these IT workers are from India.

Let us get to the interesting story from that Midwest town that I made my new home for about 4 months before I transferred out to another University in Florida in a hurry along with several other Indians who had entered the University along with me.  The other students transferred to a number of different states, for many reasons, prime among which was the lack of graduate student opportunity at this University.  From day one we faced discrimination, racism and absolute pure contempt from faculty, staff and even fellow students (White Americans).  Even today, when I think about it, it remains a surreal experience.

So, there is this graduate student, shall we call Bhola, a brilliant student with a perfect GPA and a full graduate assistantship in a discipline that was NOT engineering.  Why is that important?  Because, he was on a fast track to getting a Phd and his tuition was fully paid for.  He got money for room and board and had been resident in this town for several years before us.  So, what happened next is mind boggling because he had to be either incredibly stupid or was set up and framed by people who had nothing else better to do other than vent their racist frustrations at the first given opportunity.  One late night, Bhola drives to a nearby gas station, one of maybe a couple that was usually open late into the night and goes in to get a cup of coffee and some snacks.  For reasons that we never came to know, he gets into a heated verbal argument with the gas station attendant and threatens to come back to the station after an hour with a gun!  Incredible heh?  Wait, there is much more!

Bhola comes back to the station after approximately one hour and finds several police cars waiting for him and police officers with guns drawn!  Bhola did not bring a gun, because he never had any!  Why did he go back to the station?   Because he never got his coffee and snacks the first time around and the story goes that he had cooled off enough to calm himself and go back to get what he wanted.  Whether or not he had actually threatened the gas station attendant that he would be back with a gun strains incredulity.  One would have to be absolutely stupid and out of his mind to do that.  You see, the gas station attendant never got Bhola's car license plate number of any other identification during his first visit and it was his word against Bhola's.  Obviously, the police officers could not trace Bhola back to his house because they did not know who he was and the best they could do was wait for him to perhaps come back and let the gas station attendant identify him!  Bhola came back and before you think he was some dumb criminal, remember, he never came back with a gun and it was the gas station attendant's word against Bhola's.

Now, what happened next is pertinent to how Indian-Americans are perceived and how Indian-Americans perceive their lot in life in this country.  By and large, Indians and Indian-Americans are an extremely non-violent lot and never get into any kind of trouble, not even the trivial kind.  You don't see Indians get involved in bar fights, muggings, violent criminal activity, drug activity and so on and so forth and amazingly enough the law enforcement community recognizes that and sometimes appreciates that.  Bhola got imprisoned immediately and from accounts from my friends, I learned that he was shackled like an extremely violent criminal from head to toe so that he could only walk in a shuffle.  Bhola's long time friends immediately responded and called up his parents in India who then immediately arranged for his Paternal Uncle to fly in from Dubai right away the next day so that he could be in time for his arraignment.  Bhola's father came in a couple days later from India.  I never mustered up the courage to visit Bhola in jail even though we had started to develop a friendship during the brief time we knew each other.  I did not trust the environment and the system any more and was clearly terrified like every other Indian who had just arrived into that town that August of 1990.

During the arraignment, the Judge asked Bhola how he pled and the plea was of course, "Not Guilty."  What happened next is why I think this was handled uniquely by an Indian as opposed to the way any other immigrant might have reacted.  When the Prosecution stated its intent to fully try Bhola after the Judge denied Bail, something amazing happened!  Facing the possibility of about 25 years in prison for attempted armed robbery, Bhola seemingly was doomed.  The lawyer representing Bhola explained to the Judge that Bhola never mentioned the threat, the gas station attendant had lied and there was never a threat.  However, since Bhola and his parents did not want to be at the mercy of a system that they did not know and since they obviously could not fight a charge for quite an extended period of time while he would continue to be in incarceration, they would offer the State a unique plea deal.  Within 24 hours, Bhola would self deport himself to India while not acknowledging or denying any guilt.  The INS would escort him to the airport so that it was clear that Bhola was leaving the country.  The lawyer explained that the State would benefit by not having to spend a single penny going forward to either incarcerate Bhola or try Bhola. 

Over Prosecution protests, I am told, the Judge immediately approved the plea deal and set Bhola free on condition that he would go straight from the Jail to the airport under Police escort at which point he would be released to his parents.  The paperwork was done and Bhola left the country, perhaps never to come back!  Everyone commented on how Bhola has so easily given up on his American Dream!  Many said,"Which Immigrant would so easily and Immediately offer to self deport himself out of America?"  In retrospect, after seeing the way Dharun Ravi's case was handled and the numerous comments that I have seen about how Dharun perhaps rejected the plea deal because he did not want to get deported, I think Dharun made a mistake by going to trial.  However, that is where the rub lies!  Dharun and his parents came to the USA after 1996 during the IT Boom and think America gives and gave them equal rights and opportunities under the law just because they got equal economic opportunity.  Nothing could be farther from the truth!  I strongly believe that for most Indian-Americans, one wrong turn or one wrong mistake is the end of it all - the end of perceived prosperity!  Make one mistake and that is the end - whether it is Raj RajRathnam or Dharun Ravi.  Others and other immigrants might get a second chance, but not Indian-Americans.  Why?  Because, despite all the economic clout, Indian-Americans have very little political clout and are easy scapegoats.  They are also the object of envy.  Think about it...how many immigrants do you find landing into this country and barely a decade later own palatial homes, substantial bank accounts and portfolios and drive BMW's like Dharun and his parents did?

Dharun never had a chance and he never knew it and nor did his parents.  Had they witnessed a different America just 5 years earlier, they might have made the right choice.  They would have take the plea deal offered, tried to modify it slightly by offering self deportation immediately in return for not making the statement requested by the prosecution (that Dharun had acted out of hate) and do what any other immigrant might have considered to be the unthinkable - leave America and never come back.  Truly, by going back to India, Dharun would have lost nothing and gained everything, including his freedom.  Now, he is at the mercy of the Judge who will most certainly sentence him to 10 years in prison.  After all, it is New Jersey!

The Indianness of Dharun Ravi

It bothers me greatly that the media in some shape, form or another continues to emphasize the ethnicity of Dharun Ravi in a manner in which it is certain to be detrimental to Dharun.  After all, who would have sympathy for an Indian kid growing up in an extremely successful Indian household that chose not to convert their Green Cards (legal immigrant status in USA) to American Citizenship although they were entirely eligible to do so and yet are enormously financially successful?  How many colored immigrants into this country really show such a profile?  Is this Jealousy or is it Envy?  I wonder!

Take a look at these posts that imply that because the recent rallies in support of Dharun Ravi consist of mostly Indians or Indian-Americans, perhaps support does not exist for Dharun outside the community that he is from.  More dangerously, it implies that the only sympathy that he gets is from his own ethnic community and support does not exist outside anywhere else.  Here are the posts that mostly quote AP (Associated Press).  Most conveniently forget that Tyler Clementi's own parents are appealing for compassionate sentencing for Dharun Ravi!





Looking at the above posts, what stands out is the statement that his supporters are mostly Indian-American like he is!  If that is not subtle, implied bigotry, then what is?  Does that small detail matter?  Does that information not shape the reader's opinion?  What purpose does that detail serve other than to further rile up passions?

Furthermore, I find it interesting that the most support for Dharun Ravi comes from the LGBT community itself, a fact that does not surprise me.  The overwhelming opinion is that LGBT community knows that a colored man, Dharun Ravi was a convenient scapegoat and that Indians in New Jersey are generally targeted by many Jealous individuals and the system in New Jersey anyways.  The Indian Community in New Jersey is enormously successful and that has generated a ton of Jealousy and spite and goes back to the days of the so called "Dot Busters" where New Jersey Citizens targeted Indian Hindu Women who wore the Hindu Bindi on their foreheads with violence.  It is interesting that there is really no record of the New Jersey Criminal Justice System going after the so called "Dot Busters".  Hate Crimes it appears do not apply to Indian Victims in New Jersey - an absolute hypocrisy I think!

Here are several posts in support of Dharun Ravi, most of which are from the LGBT Community, the most prominent of which comes from the former New Jersey Governor - Jim McGreevey who was forced to leave office because he was Gay (go figure that one out).  The Star-Ledger, New Jersey's most prominent newspaper does have an editorial supporting no Jail Time for Dharun.  An Alternate Juror on the case has even publicly come out and expressed his opinion that had he been sitting in on the case, he would not have voted to convict Dharun and by the way, this Juror is NOT Indian!

I think this post below really captures the sentiment that Indian-Americans feel about the way this entire trial was handled - that if Dharun Ravi had not been Indian-American, he might not have been convicted.

For Dharun Ravi - I Suggest an Unusual Plea Deal Now!

For months, as a fellow Indian-American, I have watched with some interest, the saga of the Dharun Ravi episode that has invoked extreme reactions from both his supporters as well as his detractors.  For those not completely familiar with the case of Dharun Ravi versus the State of New Jersey, here are several links that will help familiarization with his case.  I provide that so that you can more easily follow my line of thought.

What do I suggest that Dharun Ravi do right now, this week?  Strike a deal with the Prosecutor's office and ask that they recommend that they accept Volunatary Self Deportation to India immediately within two weeks in exchange for no Jail Sentence!  YES, you read this right - I recommend offering Voluntary Self Deportation as the only way out.  That is the only way that Dharun Ravi will avoid a Jail Sentence and avoid the massive fallout that will befall him if he went to Jail.  As a fellow Indian-American and a fellow Tamilian I am absolutely sure that this is the only way out.  Dharun will not survive even one week in Jail and if he went to Jail, he will emerge either as a hardened criminal or a completely demolished individual and will be unfit to remain in any civil society as a productive individual either here in the USA or in India where he will be deported after his sentence is completed (if handed down).  Voluntary Self Deportation must be offered with the guarantee that Dharun will never, ever seek a return back to the USA, an unconditional written apology to Tyler Clementi's family and the offer of a rationale to the Judge explaining how this would save money (for incarceration) for the State of New Jersey (incarcerating Dharun for 10 years would cost a lot of money).  

Voluntary Self Deportation would be easy for Dharun and his family.  Contrary to what has been written in the press, Deportation for Dharun is not as big a deal as it is made out to be.  In INDIA, Dharun would be able to go to college (he is not a criminal there), he would be able to pursue an extremely productive and rewarding life and get a great job or even manage his father's IT business in India.  He would be able to live an Upper Middle Class life with all the luxuries that can go with it including a Car, a Driver, and several servants.  Given a choice between the USA and INDIA, several Indian Professionals choose to go back to India these days.  Indians come to the USA mostly as extremely well educated professionals and very few come because they are running away from a inhospitable country like many other immigrants.  India is a free Democracy, indeed the world's largest democracy.  There is nothing to run away from!  Indeed, there is a lot to go back to - for those who are interested.  It is not a bad deal at all.  In any case, the end point after Jail time would be forced deportation to India anyways.  So, why not offer it up - Voluntarily now?  Everyone wins.  The State of New Jersey wins by not having to spend the money incarcerating a non-violent convicted criminal whose intentions were doubtful to begin with (Dharun claims immature idiocy).  From a hate crime perspective, I think everyone is badly misjudging Dharun.  I strongly believe that Dharun was not raised as a Bigot and there is no belief in Hinduism (the religion that Dharun practices), that Homosexuality is a sin.  Indeed, in Hinduism, Homosexuality is celebrated, even in our mythology and there are numerous stories about homosexual unions between our GODS!  Unlike what I know about Christianity, there is no injunction against homosexuality.  Being a homosexual is NOT against GOD's natural will in Hinduism!

I have worked in the prison system in Ohio as an IT professional.  I have met many prisoners who have shared stories with me about what it takes to survive in a prison where it is brutal survival of the fittest and the most agile.  Agility in mind, spirit and body is of utmost importance - and there is great value to that.  There are unwritten codes and rules that a prisoner would need to follow and in prison, a prisoner might even need to join a prison gang, just to survive.  Which gang will Dharun join?  As far as I know, there are no Indian gangs in any US prison and the other established gangs are unlikely to welcome him into their fold.  Not that joining a gang is an enticing deal or easy even for an inmate of a particular ethnicity.  Dharun will also be a target of many prisoners because of the perception of his crime - that of a borderline sex offender.  No body in prison is going to parse the difference, but the fact that he was convicted of a hate crime against a Gay man will not go well with any prisoner.  Dharun will have to guard against getting raped himself in prison - sorry to be so blunt, but he will be the first target! 

I hope Dharun's parents will read this blog post and listen to a well thought advice from a fellow Tamilian.  I have struggled to decide whether to post this or not, but not having any other way to advise Dharun and his parents, this is the only way I know.  From the bottom of my heart, I say to Dharun - "Offer Voluntary Self Deportation, Offer a Written Apology and get on with life.  Do not risk going to Prison.  You will not Survive!"
